Experts discuss UAE Federal Arbitration Law

Arbitration Center, open dialogue and roundtable discuss commercial arbitration
 
Dubai International Arbitration Center (DIAC) at Dubai Chamber of Commerce & Industry organized an open dialogue and roundtable discussion on the implementation of the proposed UAE Federal Arbitration Law at the Emirates Towers hotel in Dubai on February 15.
 
Held on the sidelines of the “12 IBA Arbitration Day” hosted in Dubai by Dubai International Financial Center, the roundtable was attended Nizar Sardast, Advisor, Dubai Chamber, Dr Hussam Talhuni, Executive Director, DIAC, Board of Trustees of DIAC, members of DIAC, members of the national committee studying the UAE Federal Arbitration Law and international arbitrators attending the IBA event including Martin Hunter, Chairman of the Board of Trustees of DIAC, Essam Al-Tamimi, Director of Al Tamimi Legal Consultancy and member  of the Executive Committee of DIAC, arbitrators, lawyers, academics and decision makers in addition to managers and legal advisers.

The Chamber’s and DIAC’s organization of the roundtable was in line with Dubai Chamber’s mission that aims at protecting the interests of Dubai business community and helping widen the scope of its members’ businesses with their international partners according to the set principles and procedures of international arbitration which is today one of the most important means of resolving commercial disputes in the world.

The roundtable provided a fitting platform for local arbitrators to exchange views and experiences with their international counterparts as the discussion focused on the drafting and implementation of the Arbitration Act in the visiting arbitrators’ countries whose models could be utilized for the drafting of the UAE Federal Arbitration Law.

Later in the day, an open dialogue entitled ‘Face to Face’ dealing with commercial arbitration was attended by officials and members of the Executive Committee of DIAC. During the dialogue, the attendees discussed a range of important topics relating to commercial arbitration and neutrality, notably transparency and fairness in the arbitration, and how to accept the appointment of arbitrators, and the number and quality of cases registered in the Dubai International Arbitration Center.

Dr. Hussam Al Talhuni informed that it’s the right time to introduce a federal arbitration law in the UAE. The roundtable is organized to find answers to the implementation of the law by discussing its pros and cons and what model of the UN law will be applicable to the requirements of the UAE. 

The open dialogue was followed by a visit to the offices of the Dubai International Arbitration Center to familiarize the visitors with the services and facilities offered by the Center.

Dr. Hussam Talhuni informed that it’s the right time to introduce a federal arbitration law in the UAE. The roundtable is organized to find answers to the implementation of the law by discussing its pros and cons and what model of the UN law will be applicable to the requirements of the UAE.

Dr. Talhuni pointed out that the open dialogue reviewed the achievements of Dubai International Arbitration Center(DIAC) in Dubai and in UAE, which correspond to the achievements of prominent arbitration centers in Paris and London. He said: "The increased awareness of the arbitration services provided by the Center, and the opportunity to update on the application of certain rules, and to exchange views on topics related to international arbitration were the goals of the open dialogue, which were highlighted and widely discussed at the event."

The open dialogue was followed by a visit to the offices of the Dubai International Arbitration Center to familiarize the visitors with the services and facilities offered by the Center.
